Sona MedSpa claims the results of the arbitration were misrepresented

Sona MedSpa Plans For Growth After Favorable Arbitration Ruling

Franklin, TN, May 29, 2007 – The case of Coady, et. al. v. Sona MedSpa, et. al. was decided by an arbitrator on April 9, 2007.  The arbitrator ruled in favor of Sona on 10 out of the eleven claims brought by Coady.

Heather Rose, CEO of Sona MedSpa stated, “This case was one of a string of cases brought against us.  The coordinated attack on our business has utterly failed.  We are pleased with the result of this arbitration, and even more pleased that our franchise partners are enjoying prosperity in their Sona MedSpa businesses.”

On the single claim decided for Coady, the arbitrator found that the former owners of the business acquired by Sona did not adequately document one particular claim made to Coady in the previous sale of the franchise.  While the arbitrator found that current Sona management corrected this error once discovered, he said that they should have gone further than they did to ensure that Coady understood the correction.  The arbitrator then reduced the damages claimed by Coady to a fraction of what Coady had sought.

Meanwhile, that arbitrator found no evidence that Sona had made any knowingly false representations, breached any contracts, or failed to comply with regulatory requirements.  The arbitrator also specifically rejected Coady’s claims that his franchise was worth “little or nothing” when the litigation began, and that the earnings claim in the disclosure documents furnished to its franchisee prospects was false or fraudulent.  In fact, the arbitration decision completely clears Sona’s former CFO, who was the principal preparer of the earnings claim, from any alleged wrongdoing whatsoever.

Ms. Rose through her inexperience and lack of leadership lead Sona to it’s ultimate state. The lack of reasearch on product and promises sold to the franchisee were at least at fault. It was a scheme, pre-sale the products in bundles, the product did not work and have to service the customer into the next year while sales drop because of the poor performance of services promised. She has no shame concerning the monies and lives of people that were hurt because of her. She will move on to the next project all the while believing that the franchisee is the one at fault. Maybe we should require that the folks who sales the franchise’s should have some operational experience themself’s rather than a good pitch. I understand that she might be getting in the ice cream business. I hope it is just scooping.

How do I get my money back? I purchased laser treatment from Sona Med Spa Sacramento and didn’t get anything before they declared bankruptcy.
